GAME 4U offers this website, including all information, tools and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By accessing the website at https://game4u.co.za, you are agreeing to be bound by these terms of service, all applicable laws and regulations, and agree that you are responsible for compliance with any applicable local laws. If you do not agree with any of these terms, you are prohibited from using or accessing this site. The materials contained in this website are protected by applicable copyright and trademark law.

• Further, Game 4U does not warrant or make any representations concerning the accuracy, likely results, or reliability of the use of the materials on its website or otherwise relating to such materials or on any sites linked to this site.
• A purchase will only be concluded once a customer’s order is accepted by Game 4U and we verify that all is in order.

3. Limitations

• In no event shall GAME 4U or its suppliers be liable for any damages (including, without limitation, damages for loss of data or profit, or due to business interruption) arising out of the use or inability to use the materials on GAME 4U’s website, even if GAME 4U or a GAME 4U authorized representative has been notified orally or in writing of the possibility of such damage. • The materials appearing on GAME 4U’s website, social media pages, newsletters or any other forms of communication could include technical, typographical, or photographic errors. GAME 4U does not warrant that any of the materials on its channels are accurate, complete or current. Game 4U may make changes to the materials contained on its website and other channels at any time without notice. However Game 4U does not make any commitment to update the materials.

• GAME 4U has not reviewed all of the sites linked to its website and is not responsible for the contents of any such linked site. The inclusion of any link does not imply endorsement by Game 4U of the site. Use of any such linked website is at the user’s own risk.

6. Modifications

• GAME 4U may revise these terms of service for its website at any time without notice. By using this website you are agreeing to be bound by the then current version of these terms of service.

7. Pre-orders

• Pre-order release dates and prices are supplier dictated and subject to change. Payment has to be made in advance prior to the release date in order for the pre-order to be secured. Unpaid pre-orders may be cancelled without notice. If in the event that you pre-order a special edition, deluxe edition, limited edition or collectors edition while it is available but make payment at a later date when it is no longer available for pre-order then we will try our best to source one for you if possible or refund you the full amount of your payment.

8. Delivery

• We charge a flat rate of R150 on consoles or hardware and a flat rate of R70 on video games, apparel and small merchandise. We may also offer free shipping for a limited time or over a certain amount.
• Shipping usually takes within 1-3 business days however this time may vary based on location, logistic issues, stock availability ,or any other unforeseen events.
• In rare cases whereby the courier company is unable to deliver to certain outlying / rural areas then the customer may elect to arrange their own courier services.
• Digital vouchers will be delivered via email within after a purchase has been made and payment has been received, please note that while most vouchers will be sent out only after a couple of hours, this is largely dependent on the bank’s clearing times and can take up to 1-2 business days.
• The estimated delivery times on this website serve merely as a guideline for customers to make better informed purchases however actual delivery time may vary based on stock availability, location and other unforeseen logistical issues.

• Next day delivery is only available in main city centres and subject to the following conditions:

- Payment must be cleared by 10:00 AM on a weekday.

- Delivery location must be in a main city centre such as Durban, Johannesburg and Cape Town.

- While we do our best to ensure speedy delivery, GAME 4U will not be held liable for any delays that may occur due to unforeseen events.

- Please refer to the shipping information on your order receipt for an estimated delivery time or track your shipment directly on your account by navigating to my account > orders.

9. Governing Law

• These terms and conditions are governed by and construed in accordance with the laws of South Africa and you irrevocably submit to the exclusive jurisdiction of the courts in that State or location.

10. Price beat policy

We vow to beat any price from other physical retailers within SA as per the below conditions:

• The competitor’s price must be valid at the time of purchase at Game 4U or on the date of the price-beat request at Game 4U.
• The competitor must be a legitimate South African retailer with a physical store,
• The competitor must be in stock of that identical product at the time of the price beat.
• The products up for comparison must be identical in every respect, including in terms of brand, barcode, volume/weight.
• The warranty period of the product in question must be identical to that of the Competitor product.

The Price Beat does not apply to:

• Online retailers

• Deals linked to new store openings

• Deals linked to store relaunches

• Deals linked to store closures

• Clearance sales

• Deep discounted promotions that are short-term such as Birthday Deals, Black Friday and Cyber Monday deals.

11. Giveaways

1. By entering any Game 4U Giveaways, users are deemed to have read, understood, and accepted all of these ‘Terms and Conditions’ and agreed to be bound by them and any requirements set out in accompanying material.

2. Giveaways are open to all residents of South Africa aged 18 or over. Minors can only enter with consent of their parent or legal guardian.

3. Employees of Game 4U and affiliated companies and agents, and their family members, and anyone associated with the Giveaway may submit entries, but are not eligible to win.

4. All entries through third parties or agents are invalid.

5. The Giveaway period shall run from the dates specified in the giveaway post. Any entries received after the giveaway period has ended will not be counted.

6. There will be 1 prize draw during the Giveaway period unless stated otherwise.

7. Entry into the Giveaway is free and automatic upon following any of the steps required in the Giveaway post.

8. By entering the Giveaway, entrants are deemed to grant permission to Game 4U for their entry, name, Instagram handle, image, picture and avatar to be used. Winners may be asked to participate in unpaid promotional related publicity, unless prohibited by law.

9. Entrants will only be able to enter the Giveaway once. If multiple entries are received, only one (1) entry per entrant will be counted.

10. The winners will be selected at random by a computer from all valid entries. All decisions in connection with this Giveaway are final and no correspondence will be entered into with the entrants.

11. The winners will be notified by direct messaging following the winner selection. Winners will have three (3) days to respond providing their address in order to claim their prize.

12. The prizes will either be sent out to the winners by Fastway Couriers within fourteen days or the winner may be asked to pick up the prizes at their nearest Game 4U store.

13. Game 4U is not liable for any entries that are lost, incomplete, delayed, illegible, corrupted or damaged.  Proof of upload does not constitute proof of receipt.

14. There is no cash alternative and prizes will only be given to the confirmed winners.  

15. Game 4U reserves the right to offer alternative prizes of equal value should the advertised prizes become unavailable for reasons beyond its control.

16. Game 4U reserves the right to (a) disqualify any entrant which it believes has contravened any of these Terms and Conditions, and (b) select an alternative winner in respect of any prize they may have won.

17. The allocation of the prizes is final and binding and no correspondence will be entered into, unless requested by an entrant.
